Terms and Conditions

These terms and conditions apply to every order you place with Santa Store at santastore.co.uk. Please read them before you order. If anything is unclear, contact us using the details below.

1. About us

Santa Store is a trading name of Combrook Limited, a company registered in England and Wales under company number 12789408.

In these terms, “we”, “us” and “our” mean Combrook Limited trading as Santa Store, and “you” means the customer.

2. These terms

These terms apply to sales to consumers (people buying for purposes outside their trade, business or profession). You must be at least 18 years old to place an order. Nothing in these terms affects your legal rights as a consumer.

We may update these terms from time to time. The version on our website when you place your order is the one that applies to that order.

3. Our products

We take care to describe and photograph our products accurately, but colours may look slightly different on your screen, and packaging may vary from the images shown. Licensed and official merchandise is sold as supplied by the brand owner.

Personalised products: please check names, dates and messages carefully before ordering. We will make the item exactly as you enter it, so we cannot accept returns for spelling or other errors in the details you provide.

4. Placing an order

When you place an order we will email you to acknowledge it. This does not mean your order has been accepted. Our acceptance takes place, and a contract between us is formed, when we email you to confirm that your order has been dispatched.

We may decline an order, for example if an item is out of stock, if we cannot deliver to your address, if we suspect fraud, or if there is an obvious error in the price or description. If we decline your order after taking payment, we will refund you in full promptly.

5. Prices and payment

Prices are in pounds sterling (GBP) and include VAT. Our VAT registration is being processed; once our VAT number has been issued we will show it here and can provide a VAT invoice on request. Delivery charges are shown in your basket and at checkout before you pay.

We accept PayPal, Apple Pay and Google Pay, all processed securely by PayPal. You can also pay by debit or credit card through PayPal without a PayPal account. We do not see or store your full card details. Payment is taken when you place your order.

If we discover that a product has been listed at a clearly incorrect price, we will contact you before dispatch to ask whether you wish to continue at the correct price or cancel for a full refund.

Discount codes and promotions are subject to their stated terms, cannot be exchanged for cash and may be withdrawn at any time, though this will not affect orders already placed.

6. Delivery

  • We deliver to addresses in mainland Great Britain. We can’t currently deliver to Northern Ireland, the Scottish Highlands and Islands, the Channel Islands or the Isle of Man. If you enter an address we can’t deliver to, you won’t be able to complete your order.
  • Delivery is free on orders over £100. Standard delivery on orders under £100 costs £4.99.
  • We aim to dispatch orders within 3–5 days. Estimated delivery times are shown at checkout. Personalised items may take longer.
  • Some items are sent directly by our suppliers, so your order may arrive in more than one delivery. You pay one delivery charge per order.
  • We publish last order dates for Christmas delivery on our website each year. We will do our best to meet them, but cannot guarantee delivery by a particular date unless we have specifically agreed to.
  • If your order has not arrived within 30 days of the date we told you, you may cancel it and receive a full refund.

Your order becomes your responsibility once it has been delivered to the address you gave us, or collected by you or someone you nominated.

7. Your right to change your mind

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you can cancel your order for any reason within 14 days, starting the day after you (or someone you nominate) receive the goods. If your order arrives in several deliveries, the 14 days start the day after the last item arrives.

How to cancel: tell us clearly, by email or in writing, that you wish to cancel. You can use the model cancellation form at the end of these terms, but you do not have to.

Returning the goods: send the goods back to us within 14 days of telling us you wish to cancel. Unless the goods are faulty, not as described, not fit for purpose, or we made a mistake with your order, you are responsible for the cost of returning them. Please return items unused, in their original packaging where possible, and keep proof of postage.

Your refund: we will refund the price you paid for the goods, plus the cost of standard delivery, within 14 days of receiving the goods back or receiving evidence that you have sent them, whichever is sooner. Refunds are made using your original payment method. If you chose a more expensive delivery option, we only refund the cost of our standard delivery. We may reduce your refund if the value of the goods has been reduced because you handled them more than was needed to check them, as you would in a shop.

Items you cannot cancel for a change of mind (this does not affect your rights if they are faulty):

  • personalised items, or items made to your specification;
  • sealed items unsuitable for return for health or hygiene reasons (for example cosmetics, fragrance, bath and body products, or earrings) once the seal has been broken;
  • food, sweets and other items that can deteriorate or expire quickly;
  • sealed audio, video recordings or computer software once unsealed;
  • gift cards and digital content once supplied, where you agreed to immediate supply.

8. Faulty or incorrect items

Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. If an item is faulty, damaged or not as described, please contact us as soon as possible. Your rights include:

  • up to 30 days after delivery: a full refund;
  • up to six months after delivery: a repair or replacement, and if that is not possible or does not fix the problem, a refund in most cases;
  • up to six years after delivery: a repair, replacement or (in some cases) a partial refund, where the fault was present when the item was delivered.

We will cover reasonable return costs for faulty or incorrect items. This is a summary of your key legal rights; for detailed information visit Citizens Advice.

9. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights in relation to the products, including those under the Consumer Rights Act 2015.

Our products are supplied for domestic and private use. We are not liable for any loss of profit, loss of business or business interruption.

Please follow any safety information and age guidance supplied with products, particularly toys and electrical items, and supervise young children.

10. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, courier disruption or supplier failure. If this happens we will contact you as soon as possible, and you may cancel and receive a refund for anything you have paid for but not received.

11. Your account, wishlist and reviews

You are responsible for keeping your account password secure. If you post a product review, it must be honest and lawful, and must not be offensive or infringe anyone else’s rights. We may remove reviews that do not meet these standards.

12. Intellectual property

The content of this website, including text, images and design, belongs to us or our licensors. Character names, logos and trade marks shown on licensed products belong to their respective owners.

13. Your personal information

We use your personal information as set out in our Privacy Policy.

14. Complaints and disputes

If you have a problem, please contact us first and we will do our best to put it right quickly.

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

If any part of these terms is found to be unenforceable, the rest will remain in effect.
